The Fairfax Legal Environment

A person who dies without an estate plan still has one, because Virginia wrote it. Under state intestacy law, when a decedent leaves a spouse and has any children outside that relationship, the surviving spouse takes one-third of the estate and the children divide the rest. That default catches blended families in Fairfax off guard constantly.

Fairfax property values are among the highest in the state, so estates clear probate thresholds without anyone feeling wealthy, and an unplanned home can tie a family up in front of the Circuit Court and a Commissioner of Accounts for months. A condo in the District or a vacation home in North Carolina compounds it, since that requires ancillary probate in the second jurisdiction. A short plan leaving everything to a spouse fails under those conditions, and the failure surfaces only after the person who wrote it is gone.

A family planning ahead and getting an estate plan established.

Estate Planning Solutions in Fairfax

The available tools for estate planning include wills, revocable and irrevocable trusts (including irrevocable life insurance trusts), powers of attorney, advance medical directives, HIPAA releases, designation of final arrangements, deeds, and special needs trusts. Identifying which a family actually needs is the part of the estate planning process.

Wills, Trusts, and Keeping an Estate Out of Probate

A will guarantees probate rather than avoiding it, which is the most common misunderstanding in this area. An estate in Virginia probate answers to the Circuit Court and a Commissioner of Accounts, who review an inventory and annual accountings until it closes, all on the public record. To avoid probate a revocable living trust, beneficiary designations, and transfer-on-death deeds, are all different tools that can be utilized.

Powers of Attorney and Advance Medical Directives

Estate planning also determines who steps in if a client is at Inova Fairfax and cannot speak for themselves. A durable financial power of attorney lets a trusted person pay bills and manage accounts and an advance medical directive names a health care agent and records treatment wishes without the need of a court appointed guardian or conservator. Without these documents in place, a family may have to petition a Fairfax court for guardianship or conservatorship, which is slow, public, and expensive at the worst possible moment. These are the two documents people skip and later regret.

Special Needs, Blended Families, and Tax-Sensitive Trusts

A child who relies on SSI or Medicaid can be disqualified by an outright gift, even a modest one, so that inheritance runs through a special needs trust instead. A second marriage calls for planning that provides for a current spouse while protecting children from the earlier relationship, which form documents handle badly. Tysons executives holding equity and large life insurance policies sometimes need an irrevocable life insurance trust to keep the policy out of their taxable estate. We also handle this work for LGBTQIA+ couples, where beneficiary and fiduciary designations carry particular weight, and for clients whose prenuptial agreement has to line up with the plan.

Local Expertise:
The Fairfax County Court System

In Fairfax County, estate administration and probate run through the Fairfax County Circuit Court at 4110 Chain Bridge Road in the City of Fairfax, where the Clerk’s probate division qualifies executors and a court-appointed Commissioner of Accounts oversees the estate. The executor files an inventory within four months of qualifying and a first accounting within sixteen, then keeps filing until the estate closes, and a missed deadline can prompt the Commissioner to issue a summons.

That is a real job with real exposure, which is why the executor named in the plan matters as much as the will itself. We draft to those filing requirements and plan the administration alongside the documents.

Why Fairfax Residents Trust Eris Law Group

Our estate planning rates are published on the site, so the cost of the work is available before anyone calls.

Clients come to us from across the county, including McLean, Great Falls, Vienna, Oakton, Reston, Herndon, Burke, Springfield, and Clifton, and from nearby communities where we handle Arlington and Alexandria estate planning.

When a divorce is part of the picture, our Fairfax family law team handles it while the estate attorney rebuilds the plan around it. Although these are separate areas of law our estate planning and family law teams can and do work together if your estate plan needs to be updated to reflect your current situation during a separation or divorce.

Fairfax Legal Frequently Asked Questions

Virginia is favorable here, with no state estate tax and no inheritance tax. D.C. taxes estates at a much lower threshold, and Maryland levies both an estate tax and a separate inheritance tax that can fall on certain heirs. Real estate in either place can also trigger a second probate there, and the remedy is usually retitling, transfer-on-death deeds, or trust planning.

Usually not. Your Thrift Savings Plan, FEGLI life insurance, and survivor annuity elections pass by the beneficiary form on file rather than by your will, regardless of what the will says. An outdated designation, such as a form that still names a former spouse, overrides the plan you thought you had. We discuss beneficiary designation during the estate planning process.

Virginia gives you a partial safety net. Once a divorce is final, Va. Code § 64.2-412 revokes the gifts your will or trust left to your former spouse and strips them of any role as executor or trustee (power of attorney agent or medical agent), treating them as though they had died first. The gaps matter. It does not reach a federally governed 401(k) or pension, where federal law preempts state revocation statutes and the beneficiary form still controls, and it doesn’t always protect jointly held property and not updating estate documents may have unintended consequences (e.g. assets going to your divorced spouse’s family).
